Bulugh al-Maram 1140بلوغ المرام 1140
وَعَنْ أَبِي هُرَيْرَةَ - رضى الله عنه - أَنَّ رَسُولَ اَللَّهِ - صلى الله عليه وسلم -قَالَ : { لَا تُنْكَحُ اَلْأَيِّمُ حَتَّى تُسْتَأْمَرَ, وَلَا تُنْكَحُ اَلْبِكْرُ حَتَّى تُسْـتَأْذَنَ " قَالُوا : يَا رَسُولَ اَللَّهِ , وَكَيْفَ إِذْنُهَا ? قَالَ : " أَنْ تَسْكُتَ } مُتَّفَقٌ عَلَيْهِ 1 .1 - صحيح . رواه البخاري ( 5136 ) ، ومسلم ( 1419 ).
Narrated Abu Hurairah (RA): Allah's Messenger (ﷺ) said: "A previously married woman must not be married till she is consulted, and a virgin must not be married till her consent is asked." They asked, "O Allah's Messenger, how is her consent indicated?" He replied, "It is by her silence." .
